TRADEMARK REGISTRATION PROCEDURE

STAGE 1 – TRADEMARK SEARCH: Conduct a trademark search to check the availability of your trademark for registration and ensure compliance with the Malaysian Trade Marks Act 2019. Search results will be provided within 2-3 working days after payment.

STAGE 2 – TRADEMARK APPLICATION: Process and submit the trademark application to MyIPO. The application can be processed and submitted within 2-3 working days. The filing document and receipt will be sent directly to your email as proof of application. The examination process takes around 6 to 12 months, after which a notice of acceptance will be issued if the application is approved.

STAGE 3 – GAZETTE & REGISTRATION: Once approved, the trademark will be advertised in the government gazette for 2 months. If no opposition is filed by a third party within this period, the trademark will be officially registered, and a notification of registration will be issued. A hard copy of the registration certificate can be requested for an additional fee.

The entire registration process typically takes around 8 to 14 months for straightforward applications. Each registration is valid for 10 years and can be renewed every 10 years.

PROOF OF REGISTRATION

Once we have submitted your trademark registration application, we will email you the official confirmation from MyIPO as proof that your application has been filed. You may then use the (TM) symbol on your brand name or logo after submitting the registration application.

Once your registration is approved and gazetted, you will receive a registration notification free of charge, along with a registration certificate (subject to payment). The trademark registration will be valid for 10 years and can be renewed every 10 years. You may use the ® symbol on your brand name or logo after receiving the notification and registration certificate.

Why Your Trademark Registration Certificate Matters

Your trademark registration certificate is essential for the following purposes:

  • Taking legal action against copycats, whether through court proceedings or by filing a complaint with the Ministry of Domestic Trade and Consumer Affairs (KPDN).
  • Removing counterfeit or imitation products from e-commerce platforms such as Lazada, Shopee, and TikTok Shop.
  • Applying for a signboard license from your local municipal council (PBT).
  • Applying for business grants or loans from government agencies or financial institutions.


FAQ

What is the difference between the TM and R symbols?

The (TM) symbol is usually used to indicate that a logo is being used as a trademark for a product or service. This symbol is also used to show that a logo is in the process of getting approval for registration from the trademark registrar’s office. The (R) symbol, on the other hand, indicates that a logo or trademark has been registered with the trademark registrar’s office. To use this symbol, the logo owner must have obtained a registration certificate from the registrar.

How long is the registration period valid?

Each registration is valid for a period of 10 years from the date of application. Each registration can be renewed every 10 years as long as the trademark is still in use.

What Happens If My Application Is Rejected?

Rejected applications can still be appealed. I will assist you with a written submission or by attending a hearing session to support your appeal.

I have already registered with SSM, why do I need to register a trademark again?

Registering a company or business name with SSM (Companies Commission of Malaysia) or the Business Registrar does not automatically register the trademark/logo based on the company name. It needs to be registered separately with the Intellectual Property Corporation of Malaysia (MyIPO). For example, Maxis Communication Bhd has registered the Maxis trademark (based on the company name) with MyIPO.

Does the brand to be registered have to follow the SSM/Company name?

No, the brand does not need to be the same as the SSM or company registration. A company can register several different trademarks at the same time.

I have not yet registered my business with SSM, can I still register?

Yes, you can. Registration can be done using an individual’s name.

Is trademark registration in Malaysia valid worldwide?

No, it is only valid in Malaysia. If you want to get trademark protection abroad, it needs to be registered separately in each country. We offer services for registration abroad.
